1. Who These Terms Are Between
These Terms & Conditions apply between you and the Bazinga Parties company named in the Legal Notice of the website you’re using (“Bazinga”, “we”, “us”). By booking our services, you agree to these terms. You must be at least 18 and have the authority to make the booking.
2. What We Do
Bazinga Parties provides entertainment for children’s parties and events — including face painting, balloon twisting, party games, character performances, magic shows and related services as listed on your local Bazinga website. Exact services, packages and prices are those shown on the website for your city at the time of booking.
3. Bookings, Quotes & Payment
Bookings are made through our website or by phone. A booking is confirmed when you receive our written confirmation.
Quotes are valid for the period stated on the quote (or 14 days if none is stated). Prices in quotes are honoured for that period, subject to availability.
Payment is taken securely through our payment system (card via Stripe) or by invoice where offered. Corporate and event bookings may have their own payment schedule — up front, split, or after the event with a PO number — as stated on the quote or invoice. Invoices are payable by the due date shown.
Prices include VAT where applicable, unless stated otherwise (corporate and event invoices may show VAT added separately).
We may decline a booking; if we decline one you’ve already paid, you receive a full refund.
4. Managing Your Booking
There’s no account to create or password to remember. You manage your booking through the links in your confirmation email, or by contacting us by email, phone or WhatsApp. Instructions you send us from the contact details on your booking count as authorised by you — if your email or phone number changes, tell us.
5. Cancellations & Refunds
Cancellations, rescheduling and refunds are governed by our Refund & Cancellation Policy, which forms part of these terms. In short: one free date change with 48+ hours notice, tiered refunds by notice given, and every cancellation looked at individually.
6. What We Need From You
To deliver a great party, you agree to:
- Supervision. Our entertainers are performers, not childcare. A responsible adult (you or someone you appoint) must be present and responsible for the children at all times during the event. Entertainers may pause or stop an activity if children cannot be kept safe.
- The space. Provide reasonable and safe conditions for the booked services — enough room, access to the venue, and shelter or shade for outdoor events. Tell us in advance about anything unusual about the venue.
- Accurate information. Give us correct event details (address, times, number of children, ages, allergies where relevant to booked services).
- Conduct. Treat our entertainers with respect. We may end a performance early, without refund, if an entertainer is subjected to abuse, harassment or unsafe conditions.
7. Our Entertainers
The entertainers who perform at your event are independent professional performers, subcontracted by and representing Bazinga Parties. Every entertainer we work with is vetted, trained to our standards, and required to carry their own liability insurance naming Bazinga’s operating company in their region.
We assign the best available entertainer for your booking. If your assigned entertainer becomes unavailable (illness, emergency), we’ll provide an equally qualified replacement wherever possible — a substitution is not a cancellation. If we can’t deliver the booked service at all, our Refund Policy’s “If We Can’t Deliver” terms apply: full refund or free rebooking, your choice.
Entertainers working with Bazinga may not be approached for direct private bookings that bypass Bazinga for a period of 12 months after your event.
8. Liability
- Your contract is with Bazinga, and we stand behind the services delivered under it — even though performances are delivered by independent subcontracted entertainers (see Section 7). Where an entertainer causes damage, claims are handled through the liability insurance every entertainer is required to carry.
- We are liable for damage caused by our intent or gross negligence, and — where the law says so — for personal injury caused by our negligence. Nothing in these terms excludes liability that cannot legally be excluded.
- Beyond that, our liability for any booking is limited to the amount you paid for that booking.
- We are not liable for damage or injury arising from inadequate supervision of children (see Section 6), venue conditions we don’t control, or instructions we followed at your request.
- Face paints and materials used are professional, skin-safe products. Tell us about known allergies before the event; we’re not liable for reactions to allergies we weren’t told about.
- You are responsible for damage caused by your guests to the venue or to our equipment.
9. Insurance
Every entertainer performing for Bazinga is required, as a condition of working with us, to carry professional liability insurance naming Bazinga’s operating company in their region. Proof of insurance for your event is available for corporate bookings on request.
10. Photos & Media
Our entertainers may take a small number of photos at events for quality control. We never publish photos of your event or your guests without your explicit permission. If you’d rather no photos at all, say so at booking or on the day.
If you share photos or reviews with us or tag us publicly, you allow us to display them on our websites and social channels; you can withdraw this any time by contacting us.
11. Intellectual Property
Everything on our websites and in our performances — logos, characters, designs, images, videos, text, show formats — belongs to Bazinga Parties or our licensors. Don’t copy, reproduce or commercially use any of it without written permission. Personal photos and memories of your own party are, obviously, yours.
12. Force Majeure
Neither of us is liable for failure to perform caused by events genuinely outside our control (natural disaster, government restrictions, strikes, epidemics). If such an event prevents your booking, we’ll offer a free rebooking; if no reasonable new date works, we’ll refund what you’ve paid for undelivered services.
13. Complaints
If something wasn’t right, tell us within 7 days of the event at the contact details below. We take complaints seriously and respond within 5 business days. Giving us the chance to fix things doesn’t limit any legal rights you have.
14. Refusal of Service
We may decline future bookings from clients who breach these terms, attempt fraud, or abuse our staff or entertainers. This never touches bookings already paid: those are delivered or refunded under the Refund Policy.
15. Changes to These Terms
We may update these terms from time to time. Changes apply to bookings made after the updated terms are posted. The terms in force when you booked govern that booking.
16. General
If any part of these terms is found invalid, the rest still applies. These terms, together with the Refund & Cancellation Policy and Privacy Policy, are the whole agreement between us for your booking.
